You are in the 2nd year of a bargaining agreement and your company (City government agency) wants to implement changes to the contract. What is significant about being in the 2nd year of an agreement? The first change is a management desire to begin random drug testing for all employees. The union requests bargaining over the drug testing program and asks for all medical records of employees who were disciplined or off work due to reasons related to substance abuse. The City refuses to provide the medical records. Would this subject (drug testing) be a mandatory, permissive or prohibited issue in collective bargaining? Why would the City refuse to provide the records? The second change is a management desire to form a new employee-management committee to meet on a regular basis and do 2 things: discuss safety and efficiency issues; and, institute new policies and procedures regarding operational issues. The union refuses to bargain over this issue. Why would the union refuse to bargain over this? (think about what the purpose of a union is).
